(Transcribed by Judy Merrell Brickhouse) Book DE Page 278 North Carolina This Indenture made the tenth of June in the year of our Lord One thousand Seven hundred and Sixty Four between JESSE BRYANT & THAMER BRYANT of the County of Halifax in the province afsaid of the one part & WILLIAM BEGASST of the County of Pasquotank and province afsaid of the other part Witnesseth whereas the JESSE BRYANT & THAMER BRYANT afsaid for and in consideration of the valuable sum of two hundred & Sixty pounds procl. Money to us in hand paid before the ensealing & delivery of these presents by the afsaid WILL BURGESS the receipt whereof we do acknowledge ourselves therewith fully satisfied contented and paid and have given granted bargained sold aliended espouse conveyed and confirmed & by these presents do give grant bargain sell alien convey and confirm unto the said WILLIAM BURGESS his heirs exers. Adms & assigns a certain tract or parcel of land containing by estimation one hundred acres be it more or less lying & being on the North side of Pasquotank River commonly called the mannor land being the land where on the said JESSE and THAMER BRYANT formerly did live, butting bounding as follows, to wit Beginning at a land cedar at the mouth of Potohaunk Creek from thence running the said Creek by various courses to a red oak standing at the fork of the said Creek a corner tree thence N. W. course 14 chains to a chesnut oak BENONI BURGESS corner tree so down the said BENONI BURGES line to the river and down the river to the first station with all houses & out houses orchards garden fences feeding wood land ground cleared ground Timber or timber trees standing lying or growing upon the said plantation or moiety of land with all rights and appurtenances to the same belonging or in any wise appertaining To have and to hold the said one hundred acres of land be it more or less with all and singular its rights member uses privileges etc. to the only use benefit & behoof of the said WILLIAM BURGESS his heirs Exers Adms. & assigns forever and we the said JESSE and the said THAMER BRYANT singular for ourselves our heirs Exers. Adms. & every of them doth covenant to and with the said WILL BURGESS his heirs & that we the said JESSE & THAMER BRYANT have a good lawful and sufficient right to sell and dispose the premises afsaid with all its appurtenances to the said WILL BURGESS him or his heirs & assigns forever & by these presents for ourselves our heirs Exers Admis. Or assigns shall and will forever warrant maintain & defend the said land from the lawful claims and demands of any person or persons what soever to the only proper use benefit & behoof of the afsaid WILL BURGESS & his heirs and assigns forever In witness whereof we have here unto set our hands and seal the day & date aforesaid JESSE BRYANT seal TUMAR BRYANT seal Signed sealed & delivered In the presence of us Test JOHN MARTIN North Carolina June the 18th 1764. Then the within Deed of bargain and sale was acknowledged before me in due form of law by JESSE BRYANT & at the same time the same being privately examined freely and voluntarily acknowledged the & that she did it with out confusion let it be Registered MONTFORT ECFFECKIS Junr Registered the 26th day of November 1764
